We are proud to announce a significant victory for our Ukrainian team in a recent jurisdictional challenge. On June 6, 2024, the High Court of Justice in London upheld jurisdictional objections in the case of AerCap Ireland Capital Designated Activity Company & Ors v PJSC Insurance Company Universalna & Ors, determining that the dispute should be heard in Ukrainian courts rather than London, despite the ongoing war. Our partner, Sergiy Gryshko, provided expert evidence that convinced the court of the appropriateness of Ukrainian courts as a venue, countering claims from the lessors regarding the enforceability of exclusive jurisdiction clauses. The judge noted that the war would not likely cause substantial delays in litigating these claims, highlighting the resilience of the Ukrainian judicial system.
