Business And Human Rights. Eu Litigation
International human rights law reflects the values underlying the company values and CSR policy of Queritius. It was natural to put our litigation and arbitration experience to use by becoming involved in human rights disputes.
We represent our clients both in disputes directly concerning international human rights law and in complex disputes where human rights law is one part of the normative axis (in particular, disputes regarding Business and Human Rights [BHR] and Environmental, Social and Governance [ESG] disputes). While the overlap between business and human rights has long been recognized, especially by the United Nations, the area has begun to evolve rapidly in recent years, especially in the European Union. Effective representation in such disputes requires a combination of litigation experience and constant monitoring of the highly volatile normative environment. As a result, no large company or financial institution can afford to neglect its economic, social and governance responsibilities. Increasingly, disputes in this area are finding their epilogue in the courts.
International law on human rights
We represent clients before the European Court of Human Rights in proceedings against states related to the violation of their fundamental rights, as well parties in private disputes with human rights aspects. Aside from our commercial practice, we also harness our expertise for pro bono work in the field of human rights.
As an international dispute-settlement law firm established in the EU, we obviously assist in various domestic and cross-border EU business law disputes. These usually revolve around the free movement of goods, services, and capital and general principles of EU law, as well as secondary EU legislation (or lack thereof), contractual disputes, and public tenders. We provide assistance notably in matters regarding foreign investments, the internal market, the regulated market, trade law and unfair commercial practices, and competition law. We represent clients before the General Court of the EU in proceedings for the annulment of decisions of EU institutions and in preliminary question referrals to the Court of Justice of the EU.
We provide both comprehensive human rights and EU litigation services (from the start of the dispute to the final judgment), as well as assist other law firms specialised in domestic litigation, enhancing their international litigation capacities.
